Workers’ Compensation Benefits in Mississippi Explained

If you have been injured at work, physical pain may just be the beginning of your troubles. Medical bills can quickly add up, and missed work means lost income that you need to support your family. Fortunately, the Mississippi Workers’ Compensation Law provides a crucial safety net for workers.

Because Mississippi operates on a “no-fault” system, you are generally entitled to benefits regardless of who was at fault in the accident. However, navigating the claims process can be complicated. Knowing exactly which benefits you are eligible for in 2026 is the first step towards securing your future.

1. Comprehensive Medical Benefits

The most immediate benefit that you will receive after an injury at work is medical coverage. According to Section 71-3-15 of the Mississippi Code, your employer’s insurance is required to provide all necessary medical, surgical and hospital care.

This benefit covers:

  • Emergency room visits and hospitalization
  • Surgeries and specialized treatments
  • Prescription medications and medical devices, such as crutches and braces
  • Physical therapy and ongoing rehabilitation

Additionally, Mississippi law allows you to choose one competent doctor of your choice to oversee your treatment. This ensures that you receive care from a trusted doctor, rather than relying solely on a company-appointed physician.

2. Wage Replacement (Disability) Benefits

If your doctor recommends that you stay home to recover, workers’ compensation may provide wage replacement benefits. According to Miss. Code Ann. § 71-3-17, these payments are typically calculated at two-thirds (66-2/3%) of your average weekly wage, with an annual maximum limit adjusted for 2026.

These disability benefits can be divided into four main categories:

  • Temporary Total Disability (TTD) – Paid when you are unable to work completely during your recovery period. These benefits start after a 5-day waiting period. If you miss more than 14 days, you will also receive compensation for the first 5 days retroactively.
  • Temporary Partial Disability (TPD) – If you can work on light duty, but earn less than your regular wage, TPD pays two-thirds of the difference between your pre- and post-injury income.
  • Permanent Partial Disability (PPD) – When you reach Maximum Medical Improvement (MMI), but have a permanent impairment, such as the loss of a hand or leg, you may receive PPD payments. The duration of these benefits is based on specific schedules for different body parts, as outlined in Mississippi law.
  • Permanent Total Disability (PTD) Benefits: If your injury is severe and you cannot return to work, you may be eligible for PTD benefits. These benefits are typically capped at 450 weeks maximum.

3. Vocational Rehabilitation

Sometimes, an injury can leave you unable to return to your previous job. In such cases, workers’ compensation may provide vocational rehabilitation services. These benefits are designed to help you learn new skills, update your resume or transition to another industry that takes your physical limitations into account.

4. Death and Survivor Benefits

In the unfortunate event of a workplace accident resulting in the death of an employee, the Mississippi workers’ compensation system offers financial support to surviving spouses and dependents. Families of the deceased can receive wage replacement benefits for up to 450 weeks, an immediate lump sum payment to the surviving spouse, as well as assistance with funeral and burial costs.
